Ameesha Patel accused of cheating 2.5 crore: Supreme Court stays ongoing criminal offense case against actress

The Supreme Court has granted a final stay in the ongoing lawsuit against Bollywood actress Ameesha Patel. In fact, the Jharkhand Magistrates Court had issued subpoenas against Ameesha for cheating and breach of trust. After that, Ameesha filed a petition with the Supreme Court. Now, a panel of Judges BR Gavai and PS Narasimha has sent notice to Jharkhand government on this.
However, the Supreme Court ruled that prosecution for offenses punishable under Section 138 (bad check) of the Negotiable Instruments Act should be conducted according to law. “Issuing notice only in the case of an offense punishable u/s 406 (criminal offence) and 420 (cheating) of the Indian Penal Code 1860. Ongoing trial under Sections 406 and 420 of the ICC is stayed until at further order.”
The bench further said, “We clarify that with respect to the offense punishable under section 138 (bad check), it must be prosecuted according to law.” This Supreme Court order follows a motion filed by Amisha. In fact, on May 5, 2022, the High Court of Jharkhand dismissed the request for the mistrial of the pending trial in the Magistrate Court against Ameesha.
Producer Ajay Kumar Singh had filed a complaint against Amisha Patel. It was said in the complaint that Ajay transferred Rs 2.5 crore to Ameesha’s bank account to make a movie named Desi Magic. However, Ameesha neither started production work on the film nor returned the producer’s money.
